A HARARE man has dragged the Zimbabwe Defence Forces (ZDF) commander Edzai Chimonyo to the High Court demanding $15 000 compensation, claiming he was abducted and assaulted by soldiers in November 2017. In the application, Cardwell Katandike is the applicant, while Defence minister Oppah Muchinguri-Kashiri and Chimonyo, are cited as respondents.

"On or about the 20th of November 2017, at around 1100hrs, plaintiff (Katandike) was abducted by Zimbabwe National Army (ZNA) officers in Waterfalls Harare. The plaintiff was detained by the aforesaid ZNA officers for about 10 hours at Commando Barracks.

"Whilet in detention, plaintiff was assaulted indiscriminately all over his body with an object which he failed to identify. As a result of the actions of the said ZNA officers, plaintiff suffered damages of unlawful arrest and detention," Katandike said.

He told the court that as a result of the detention, he was deprived of his liberty and suffered patrimonial loss through medical expenses incurred. "The actions by the said ZNA officers are unlawful and not justifiable in the circumstances thereby rendering their actions wrongful," he said.

He further said when the soldiers assaulted him, they were under the employment of the ZNA, making the organisation liable for damages incurred. Katandike said as a result of the assault and detention, he has to be paid $15 000 in compensation.

He said $10 000 is for unlawful arrest and detention, while the $5 000 is for shock, pain and suffering.
