ZBC ordered to reinstate top buyer

THE Labour Court has ordered State broadcaster, the Zimbabwe Broadcasting Corporation (ZBC), to reinstate its procurement executive officer, Constantino Tsatsayi, whose contract was terminated last year after he was accused of leaking sensitive company documents to the Zimbabwe Anti-Corruption Commission (Zacc).

The documents relate to the ZBC-Croco Motors vehicle acquisition deal which Zacc was investigating.

"The claimant is, hereby, reinstated to his former position without loss of pay and benefits from the date of his dismissal. If reinstatement is no longer tenable, parties can quantify damages in lieu of reinstatement," the labour officer, who was only identified as J Likwesa, ruled.

During investigations, Tsatsayi was initially transferred to ZBC's Gweru offices and later had his contract terminated on three months' notice.

When Tsatsayi challenged his dismissal, which he said was done unprocedurally, ZBC, through its lawyers from Rubaya and Chatambudza Legal Practitioners, insisted that he had breached terms of his employment contract by leaking company documents to Zacc.

But the court ruled that ZBC had not followed its code of conduct in arriving at the decision.
